Apple has lost a chance to halt changes to App Store fees as cases go to the Supreme Court


Epic Games has won another victory in its battle with Apple over App Store fees, as the US Court of Appeals for the Ninth Circuit has now ruled against the Fortnite developer. The decision means that Apple should continue to allow developers to use foreign currencies in apps without charging a fee.

The old law allowed Apple to temporarily suspend important changes to the App Store it asked for Supreme Court review. Epic games to be mocked Apple’s move as “another delay” and asked the court to reconsider the decision.

The latest ruling means that Apple’s request to stop the update has been reversed, shifting things on behalf of manufacturers and forcing the iPhone maker to keep its updates, at least for now.

The final outcome of the case will determine whether Apple can collect fines for purchases made outside of its US App Store — and if so, how much.

In post on XEpic celebrated the court’s decision in favor, pointing out recent reservationwhich said, “Apple has failed to show good cause to uphold our permanent order. Apple has not shown that the current refund process would cause irreparable harm if our decision is not stayed.”

In other words, the court was not concerned that Apple would suffer more if the changes to the App Store remained in place while the legal battle continued.
