How long does Anthropic’s lease with SpaceX last? Opinions vary.


Earlier this month, xAI signed A strong connection with Anthropicpledging billions of dollars a month to invest in the company’s Colossus team. It was a takeover of both companies, giving xAI the money it needed and helping Anthropic capture the eternal computing race.

But this morning at XElon Musk downplayed exactly how much SpaceX was involved in the deal.

“SpaceX has not committed to leasing Colossus for many years, although it is possible that would happen,” he said, in response to a user. “These are leased for 180 days and the information is downloaded for 90 days. The short term was our request, not Anthropic’s. We will not leave them far away and we will provide a way to find a better solution, but if the compute is too strong, I said we may need it again at a later time.”

Musk’s statement directly contradicts SpaceX recent S-1 filingwhich guarantees a 90-day cancellation but presents the contract as a three-year contract. Page F-62 of the document states:

On May 3, 2026, the Company entered into a cloud services agreement with Anthropic PBC, an AI research and development organization, in connection with computing opportunities. Under the agreement, the customer has agreed to pay monthly until May 2029, with an increase in May 2026 at a reduced rate. This Agreement may be terminated by either party upon 90 days’ notice. Customer shall retain ownership and intellectual property rights in its Content, AI models, and related data.

The key point here is that Anthropic has “agreed to pay monthly fees until May 2029” – a clear description of the three-year lease. The same language is repeated on the F-96 and in different forms (“clients agree to pay us $1.25 billion per month through May 2029”) on pages 13 and 146, so it’s not like there was a typo.

xAI did not respond to the request for clarification.

We can probably argue whether Anthropic agreeing to pay for the service means the same thing as SpaceX agreeing to provide the service, but that doesn’t mean “renting” it. And why have one foreclosure if either party can terminate the contract with three months’ notice?

I don’t have the contract in front of me, so I don’t know what he’s talking about – either Images of SpaceX or Anthropic they say nothing about the duration of the agreement in their announcements. However, there must be a point to be made in this matter, and it is not something you want to say falsely during the company’s quiet time.

As always, we have to realize that the SEC probably won’t do anything – and even if they do, Elon probably won’t care. But it looks like this material misrepresentations made in securities advertisingwhich is bad karma to say the least.
