Elon Musk’s xAI is running about 50 natural gas turbines at its data center in Mississippi, a power plant that the state doesn’t regulate because of the recent shutdown.
Generators are considered “mobile” in the state of Mississippi because they sit on flatbed trailers, allowing them to evade emissions regulations for up to a year. The NAACP, which has filed a lawsuit on behalf of residents in the area, says the fumes from the power plant are worsening air quality in an already polluted area. This week, it asked the court the law against xAI.
The issue is the “mobile” nature of the turbines. The Southern Environmental Law Center, which filed the lawsuit on behalf of the NAACP, said the turbines are being used in violation of federal laws, which state that electricity installed on a trailer can be considered stationary and subject to air pollution regulations.
XAI is licensed for 15 of its turbines. A press release from the Greater Memphis Chamber of Commerce previously said “about half” of the 35 turbines operating in May 2025 will remain on site. However, xAI has continued to post more. Currently, it is working 46, according to a local report.
