A New Mexico judge denied the state’s motion to continue detaining Bousfield, 68, before and during his trial during a hearing on Tuesday, Jan. 20. The judge ruled that the state failed to adequately prove that there were zero conditions for releasing the director to protect the safety of the community.
Busfield’s release from prison did come with some conditions, however. Directors must attend all hearings and maintain contact with their attorneys. He may not have been in possession of a firearm and had no contact with the alleged victim. The judge did not take away Bousfield’s ability to travel. Bousfield’s next court hearing has not yet been scheduled.
After ruling, Busfield turns to wife Melissa Gilbert. He appeared to try to put his hand on his chest in a potential gesture toward Gilbert, 61, but was unable to do so due to the restraints of the handcuffs. Busfield was then escorted from the courtroom.

The show aired from 2022 to 2025. Busfield executive produced 14 episodes of the Fox series, directed six, and appeared in just one episode.
The alleged incidents occurred between late 2022 and early 2024, according to an affidavit obtained by the Albuquerque Police Department US Weekly January. Bousfield is accused of touching one of the children’s “private areas,” tickling the children, picking up the children and more.
Bousfield faces two counts of sexual abuse involving a minor and one count of child abuse. If convicted, he faces up to 15 years in prison, according to the Bernalillo County District Attorney’s Office.
In interviews with authorities, Busfield denied the abuse allegations and claimed there was nothing “weird” about his interactions with the child actors.
“I mean, I’m always around people, right? It would be, you know, in front of parents. It’s never going to be a weird moment,” he said. “I don’t really remember picking up those boys. I remember picking up the boy who was following them. I would pick him up and he would giggle, and that would get him ready for action.”
Bousfield claimed that the children were “never alone on set without teachers, welfare workers or parents.” He also admitted that he and Gilbert bought the children Christmas gifts.
After news of the charges broke, Bousfield surrendered to police while maintaining his innocence.
“I didn’t do anything to those little boys,” Bousfield claimed in the video obtained by TMZ. “I’m going to fight it. I’m going to fight it with a great team, and I’m going to be exonerated. I know I am, because it was all so wrong, such a lie.”
Gilbert attended Tuesday’s hearing to support her husband. The actress was also included in Case witness list. In addition to siding with Bousfield, Gilbert previously issued a statement defending her husband’s innocence.
“During this time, her focus is on supporting and caring for their extended family as they get through this moment,” Gilbert’s rep said. “Melissa stands with and supports her husband and will speak to the public at the appropriate time.”
