In a statement shared by the Maricopa County Prosecutor’s Office, they confirmed “there is no possibility of a conviction.” Brady’s attorney later publicly thanked officials for a thorough investigation and called the case “a tragic accident.”

“Words cannot describe the feeling of such a huge loss,” Kizer wrote on Instagram in August. “I spent days, weeks, months trying to find them and taking some time to process the loss of my child.”

She continued: “Trig was our baby and our best friend. The light and spirit he brought to this world was bright, pure, joyful and undeniable. We miss him every second of every day and moving on often feels unbearable. I never thought we would experience grief or the pain of losing him so suddenly in this way.”

At the time, Emily “took full responsibility as Trigg’s mother,” adding, “I knew I should have done more to protect him. One of the hardest lessons I learned was that a permanent pool fence could have saved his life, and it’s something I will never ignore again. I hope that in the midst of this pain, Trigg’s story will help prevent other children and families from suffering the same loss.”
